Cine Artist (CineArtist.com.au) is an employment agency in media sector that offers a job-hunting service under the following terms and conditions. Delivery Around Pty Ltd, Victoria, ABN 48649271778, owns the media brand Cine Artist (CineArtist.com.au).
You are only registered with us once you have received an acceptance email, which normally happens within 96 hours of submitting this form. You will be registered with Cine Artist from the date of acceptance if you are accepted. We retain the right to deny you access to our site.
Cine Artist Victoria agrees to market the talent through advertising agencies (including Casting Networks), film studios, production houses, print media, fashion houses, photographic studios, and other venues by accepting this agreement.
Cine Artist Victoria's performers are required to have professional headshots. This information will be made available to the advertising industry, and it will be included in our database and on our site. Casting, modelling, film, and television ventures may all benefit from this.
The agreement is for a year. For the following 12 months, there is no price, but if you want to continue working with the agency, you must pay $100 every year for photoshoots and updating the profile to stay on the books.
It is the talent's job to keep his or her look at all times. It is also the responsibility of the talent to inform the agency if his or her measurements changes. To avoid the agency misrepresenting the talent, it is recommended that the talent tell the agency before changing his or her look like haircut or colour.
As an agency charge, a 15% deduction will be made from the talent's compensation (acting work-film and television).
As an agency charge, a 20% deduction will be made from the talent's compensation (modelling work-photography, commercials, promotions etc.).
Unless accompanied by a valid medical certificate, the agreement will be dissolved and the booking money forfeited if the talent fails to attend for any booked jobs.
It is entirely up to the talent to take any job that is offered to them.
Although every effort is made to find work for the talent, there is no guarantee that every talent will be employed because the client's casting director makes the ultimate decision. Because all casting and modelling assignments are selected by the customer, Cine Artist cannot guarantee work. Cine Artist goes to great lengths to advertise and secure business for its clients. Cine Artist, on the other hand, gives no promises on the talent's employment.
You acknowledge that all cameras, including mobile phones, are absolutely banned on any set. If you're caught using a camera, the producer has the authority to take it away and send you home without pay. You are not authorised to discuss any part of your booking on social media or on the internet, or to speak with any journalist or magazine about it.
You are adaptable. You'll need to be able to work around your schedule and be available on short notice.
You possess a "can-do" mentality. You'll need to be a morning person who doesn't mind long filming days.
You want to work in the film industry in a variety of capacities. You're not only focusing on stuff that's been featured.
There is no upfront charge to join. There are no fees associated with joining, registering, or appearing on the website.
You give Cine Artist Ltd permission to accept payment from the production company and deposit it in our trust account on your behalf. We will transfer the rest of the money straight to you by EFT once we have received payment from the customer, after deducting a 15 percent or 20% fee.
You authorise Cine Artist to retain your personal information on file and to share any relevant information with any production that requests it.
You give us permission to use your photo and vital statistics on our website and in other Cine Artist publications.
This agency agreement can be cancelled at any time by any party with written notice.
Cine Artist has the right to organise castings and bookings, negotiate remuneration, and execute contracts on behalf of every talent listed here.
Please note that this is a working agreement between talent and Cine Artist, not a contract.
Every employee is responsible for their own taxes and personal insurance needs.
Cine Artist will make every effort to promote talent to its maximum potential, but work cannot be guaranteed. Also, keep in mind that for all work assignments, the final choice is in the hands of the clients.

At all times on set, maintain a professional demeanour.
Always arrive on time.
I realise that production houses, not Cine Artist, are responsible for paying employees, taxes, social security, and vacation pay. Once Cine Artist receives your payment, the agency commision is deducted and you are paid directly into your bank account. You will get payment instructions via email, including your payslip and payment breakdown.
Consent to the publication of your photograph and testimonial remarks on our website and/or Facebook pages.
No alcohol or illicit substances may be consumed before to, during, or after the shoot. If you are apprehended, the producer has the authority to send you home, which may influence your remuneration and result in the termination of your profile.
No kind of harassment will be permitted against Cine Artist employees, fellow performers, or customers. Cine Artist and the production company reserve the right to send you home, which may result in a reduction in your compensation and the termination of your profile.
I agree that any cameras, including those on mobile devices, are absolutely banned on any set. If I am found using a camera, the production has the right to seize it and may send me home without compensation.
I accept that you are solely responsible for any personal things brought on set. Cine Artist is not responsible for any materials that are lost, damaged, or misplaced on set.
Cine Artist will make every effort to maximise the potential of any talent, but cannot promise any specific role, since final casting choices are made by the Production Companies' casting directors.
I affirm that I am not represented solely by another agency and that Cine Artist is free to represent me. If I am represented by another agency and that agency charges a commision on work booked and completed via Cine Artist, the fee will be removed from my own profits.
I understand that Cine Artist reserves the right to cancel or reschedule a photoshoot or information session.
I understand that there are no refunds for photoshoots / photo appointments once the session has been reserved, booked, photos taken, completed, or for a change of mind or rescheduled Photoshoot. The only exclusions are those explicitly stated in Australian law.
I understand that I am unable to cancel photoshoots / photo sessions once they have been scheduled. I will not get a refund or credit towards a future photography if I cancel my photoshoot.
I consent to receiving messages and phone calls from Cine Artist or on its behalf. For instance, you may get reminder messages or updates on a future Information Session, talks about Cine Artist representation, upcoming picture shoots, and film, commercial, and television jobs.
Cine Artist reserves the right to suspend your representation in the event of a violation of the above
Terms and conditions for Clients
Bookings: No project may be booked unless Cine Artist receives an emailed brief from the client and/or a confirmation from the agency.
Assignment types include:
Film and television: All bookings need a minimum of a four-hour call. Background extras are paid at MEAA (equity) rates. Contracts are negotiated for featured, bit-part, and lead actors.
Photographic: All photography projects will be compensated at a set fee. Hourly, half-day, or full-day rates are available, plus an applicable use cost. All photos must be used solely for the reason for which it was shot. Any additional usage or region must be agreed with the agency.
Rates for commercials must be set by industry contract or negotiated at the time of casting/booking.
Rates for stage programmes must be set by industry contract or negotiated at the time of casting/booking.
Rates for pop promos/corporate videos/promotion/voiceovers will be discussed at the time of casting/booking. Where relevant, MEAA equity rates will apply.
At the time of booking, it is the client's obligation to supply the agency with contracts for commercials, still images, or corporate films. Clients must tell the agency if their usage is extended or changes.
Wardrobe/Make-up Calls: Wardrobe and make-up calls for film and television are charged at MEAA rates. Otherwise agreed upon between Cine Artist and the customer before to the task.
Travel payments: Prior to the job, Cine Artist and the customer will agree on any travel payments. Locations within a 25-kilometer radius of Melbourne's CBD are ineligible.
Meals: On all appointments lasting more than four hours, clients are responsible for providing all meals.
Usage: Before the task begins, the status of an assignment must be agreed upon. If this status is discovered to be different after completion, the performer may be eligible for an upgrade. Photographic and television commercial booking fees will include a negotiated usage charge for featured-visual or main talent. Unless specifically authorised in writing for abroad or prolonged use, usage is limited to the local territory, rural, or Australian. For all known projected nations outside than Australia, additional costs are payable for the right to use images and film in part or whole.
Point of Purchase/Product Booking: Unless discussed and cleared with the agency prior to the start of the booking, no advertisement, poster, billboard display/card, swintag package, point of purchase, or usage of model name may be utilised. It is the client's obligation to check for conflicts in product bookings with the agency.
Employment: During the course of the job, the employment status of all artists will be determined by the specific contract with the production firm.
Nothing in this agreement implies that the artists are employees of Cine Artist in any manner. The artists will be represented by Cine Artist.
The Australian Taxation Office's (ATO) "PAYG withholding for performing artists" rules describe the Client as the "end-user." The following ATO instructions may be found on the internet: PAYG withholding for performing artists. * According to the ATO's "Superannuation Guarantee Ruling SGR 2005/2," the Agency is a "Intermediary."
This ruling's web URL is: http://law.ato.gov.au/atolaw/view.htm?Docid=SGR/SGR20052/NAT/ATO/00001. From Point 69 onwards, see the definition of "Agency." Once a booking is confirmed with the Agency, a contract is formed between the Client and the Artist, whether written, written and partially oral, or entirely oral, as stated in the ATO's "Superannuation Guarantee Ruling SGR 2005/2" (point 38). Even if a contract exists between Client and Artist, the Agency is permitted to raise invoices and collect payments on behalf of the Artist as an intermediary under the ATO's "PAYG withholding for performing artists" rules.
The production company is responsible for the health and safety of all hired artists on site (the employer). To insure Artistes, the production business must have enough employers liability and public liability insurance in place. Health and safety are of the utmost importance, and the production firm is responsible for them (the employer). It is critical that working procedures are followed at all times. Failure to comply with Health and Safety requirements is a serious irremediable breach of this agreement.
Cancellations: All booking cancellations must be made with at least 24 hours' notice. Cancellation costs apply if less than 24 hours notice is given.
Provisional Booking: If a customer does not exercise their choice to release or confirm a provisional booking, the agency retains the right to cancel the booking, giving other secondary or definite reservations priority.
Payments: All payments must be sent to Delivery Around Pty/Ltd and deposited into our account.
Please keep in mind: We, the agent, work alone for and on behalf of our models, and while we make every effort to offer a pleasant and efficient service, we cannot be held ultimately liable for the models' behaviour on assignment.
